Partner and Venue Listing Terms

Home / Partner and Venue Listing Terms

Last updated October 28, 2026

These terms apply to any business that lists itself in a Colorado Under Par directory. That includes golf courses and other venues (“Venues”) and vendors, suppliers and service providers (“Vendors”). In these terms, Venues and Vendors are both called “Partners.” “CUP,” “we” and “us” mean Colorado Under Par. “You” means the Partner and the person who accepts these terms for it.

By creating, claiming or managing a listing, or by buying a paid upgrade, you agree to these terms. If you do not agree, do not create or manage a listing.

1. The directory and listing tiers

1.1. CUP runs online directories of Colorado Venues and Vendors that serve golf and sporting events.

1.2. A basic listing is free. It stays free for as long as CUP offers the directory.

1.3. Partners may buy paid upgrades. The name, price and features of each upgrade are shown on the CUP website and at signup at the time you buy.

1.4. CUP may rename upgrades. CUP may improve or adjust features over time. If we remove a core feature of a paid tier during your paid year, you may cancel and ask for a prorated refund of the unused part of that year.

2. Authority to manage the listing

2.1. You must have authority to act for the business you list or claim. You confirm that you are an owner, officer, employee or authorized agent of that business.

2.2. When you claim an existing listing, CUP may verify your claim. We may ask for proof, such as an email from the business domain, a phone call to the business’s public number, or other reasonable evidence. We may approve, delay or deny a claim at our discretion.

2.3. If more than one person claims the same listing, CUP may decide who manages it, or may pause the listing until the dispute is resolved.

2.4. You are responsible for everyone you allow to manage your listing.

3. Accuracy of your listing

3.1. You must keep your listing accurate, current and not misleading. This includes your business name, description, services, photos, offers and contact details.

3.2. You must update or remove information that becomes out of date, such as closed facilities, discontinued services or expired offers.

3.3. You must not post content that is false, infringes anyone’s rights, is unlawful, or is offensive.

4. License to display your content

4.1. You keep ownership of your logo, photos, text and other content (“Partner Content”).

4.2. You give CUP a non-exclusive, royalty-free, worldwide license to use, copy, display, resize, crop, format and distribute Partner Content. This license lets us show your listing on the CUP website, in emails, in event pages and in social media and marketing that promote the directory or your listing.

4.3. The license lasts while your listing is active and for a reasonable time after, so we can remove content from live pages and emails. It does not require us to remove content from emails already sent or from archived backups.

4.4. You confirm that you own Partner Content or have permission to use it, and that CUP’s use as described here will not infringe anyone’s rights.

4.5. Photos and video of you, your staff, booth, venue or signage taken at events listed or run through CUP may be used by CUP under the CUP Media Release, including on the CUP website, social media, email newsletters and promotional materials.

5. CUP review and right to edit, decline or hide

5.1. CUP may review any listing, claim, offer or change before or after it goes live.

5.2. CUP may edit Partner Content for format, length, clarity, spelling and consistency with our site style. We will not change the meaning of your offers or pricing without asking you.

5.3. CUP may decline, hide, suspend or remove any listing or content, in whole or in part, at any time. Reasons may include inaccuracy, complaints, unverified claims, inactive businesses, legal risk, or conduct that harms CUP, organizers or golfers.

5.4. If we remove a paid listing for reasons other than your breach of these terms, we will refund the unused part of your paid year.

6. No endorsement

6.1. A listing, badge or upgrade, whatever CUP names it, is a paid or promotional placement. It is not an endorsement, certification or guarantee by CUP of your quality, licensing, insurance or performance.

6.2. You must not state or suggest that CUP endorses, guarantees or certifies your business, other than by accurately describing your listing tier.

7. No guaranteed results

7.1. CUP does not guarantee any number of views, clicks, leads, introductions, inquiries, bookings or sales.

7.2. Directory placement, search order and featured spots may change based on factors CUP chooses, including tier, location, relevance and site design.

7.3. Any statistics we share about views or clicks are estimates. They may be affected by ad blockers, privacy settings, bots and tracking limits.

8. Offers, codes and perks you post

8.1. If you post an offer, discount, promo code or perk (including perks for CUP Club members), you must honor it as posted. This applies until the stated end date, or until you remove it from your listing.

8.2. You set the terms of your offers. State any limits clearly, such as dates, minimum purchase, blackout dates or one per customer.

8.3. You are responsible for delivering the product or service behind any offer. CUP is not responsible for your offers and does not pay for them.

8.4. If a golfer or organizer complains that you did not honor an offer, CUP may contact you, hide the offer, or remove your listing.

9. Organizer introductions are referrals only

9.1. CUP may connect you with event organizers. This can happen when an organizer clicks your listing, uses an “I’m interested” button, or asks CUP for a recommendation. In those cases, CUP may share the organizer’s contact details with you, and your details with them.

9.2. Every introduction is a referral only. CUP is not a party to any agreement between you and an organizer. You contract directly with the organizer for pricing, deposits, contracts, insurance, delivery and payment.

9.3. CUP does not guarantee that any organizer will pay you, follow through or behave in any certain way. CUP does not guarantee that you will win the business.

9.4. You must use organizer contact details only to respond to the organizer’s interest in their event. You must not sell them, add them to unrelated mailing lists without consent, or share them with others. You must follow anti-spam laws (including CAN-SPAM) and honor opt-out requests.

9.5. Unless CUP and you agree otherwise in writing, CUP does not charge you a referral fee or commission for introductions.

10. Founding Partners

10.1. CUP may invite a curated group of businesses to be Founding Partners. Selection is at CUP’s sole discretion.

10.2. A Founding Partner receives the features of CUP’s top paid partner upgrade at no charge through December 31, 2027.

10.3. On January 1, 2028, a Founding Partner listing moves to the free tier unless you choose to subscribe to a paid upgrade. CUP will not charge you automatically when Founding status ends. You must actively sign up to continue paid features.

10.4. CUP will try to remind you before Founding status ends. Missing a reminder does not extend Founding status.

10.5. CUP may end Founding status early if you breach these terms.

10.6. You may describe your business as a “Founding Partner of Colorado Under Par” while the status is active.

11. Paid upgrades: price, billing and renewal

11.1. Price. The price of each upgrade is shown on the CUP website and when you sign up. Prices are in U.S. dollars. Prices do not include any taxes that may apply.

11.2. Payment. Upgrades are billed through Stripe as subscriptions. CUP uses Fluent Forms on our website to start the subscription. You authorize CUP and Stripe to charge your payment method for the first year when you sign up, and for each renewal year as described below.

11.3. Automatic yearly renewal. Your upgrade renews automatically every year on the anniversary of your signup date. It keeps renewing until you cancel. Each renewal is charged at the then-current price for your tier, subject to section 11.6.

11.4. How to cancel. You may cancel at any time from the My business area of your CUP account. You may also cancel by emailing CUP at am@coloradounderpar.com. Cancellation stops the next renewal.

11.5. When cancellation takes effect. Cancellation takes effect at the end of your current paid year. Your paid features continue until then. After that, your listing moves to the free tier. We do not give prorated refunds for unused time, unless the law requires it or these terms say otherwise.

11.6. Renewal reminder. CUP will email you a reminder 25 to 40 days before each renewal date. The reminder will state the renewal date, the amount to be charged, and how to cancel.

11.7. Price changes. CUP may change upgrade prices. We will email you notice of a price change at least 30 days before it applies to your renewal. The renewal reminder may serve as that notice if it meets the 30-day timing. If you do not want to pay the new price, you may cancel before the renewal date.

11.8. Failed payments. If a renewal charge fails, Stripe may retry it. If payment is not completed within 14 days, CUP may move your listing to the free tier until payment is made.

11.9. Chargebacks. If you dispute a charge with your bank instead of contacting us, CUP may suspend paid features while the dispute is open.

12. Your responsibilities

12.1. You are responsible for your own business, including licenses, permits, insurance, taxes, staff and the quality of your products and services.

12.2. You must follow all laws that apply to your business and your offers.

12.3. You must not use the directory to spam, scrape or harass golfers, organizers or other Partners.

13. Termination

13.1. You may close your listing at any time by contacting CUP or using your account settings. Closing a listing does not cancel a paid subscription unless you also cancel it under section 11.4. CUP will cancel the subscription when you ask us to close your listing.

13.2. CUP may suspend or end your listing or account at any time if you breach these terms, if your claim cannot be verified, if your business closes, or if we stop offering the directory.

13.3. If CUP stops offering the directory or a paid tier, we will refund the unused part of any paid year.

13.4. Sections 4.3, 4.4, 6, 7, 9.2 to 9.4, and 14 to 18 survive termination.

14. Disclaimers

14.1. The directory and all CUP services are provided “as is” and “as available.”

14.2. To the fullest extent the law allows, CUP disclaims all warranties, express or implied. This includes warranties of merchantability, fitness for a particular purpose and non-infringement.

14.3. CUP does not warrant that the site will be error-free, uninterrupted or secure, or that listings will be displayed in any certain way.

15. Limitation of liability

15.1. To the fullest extent the law allows, CUP will not be liable for any indirect, incidental, special, consequential or punitive damages. This includes lost profits, lost business, lost data or reputational harm.

15.2. To the fullest extent the law allows, CUP’s total liability for all claims relating to these terms or your listing is limited to the greater of (a) the amount you paid CUP in the 12 months before the claim arose, or (b) $100.

15.3. These limits do not apply where the law does not allow them.

16. Indemnity

16.1. You will defend, indemnify and hold harmless CUP and its owners, staff and contractors from claims, losses and costs (including reasonable attorney fees) that arise from:

  • your Partner Content;
  • your offers, products or services;
  • your agreements or dealings with organizers, golfers or sponsors; or
  • your breach of these terms or the law.

17. Changes to these terms

17.1. CUP may update these terms. We will post the new version with a new “Last updated” date.

17.2. For material changes, we will email the account contact at least 30 days before the change takes effect. If you do not agree, you may cancel your upgrade or close your listing before the change takes effect. Continuing to use your listing after that date means you accept the change.

17.3. A change will not raise the price of a paid year you have already paid for.

18. Governing law and disputes

18.1. These terms are governed by the laws of the State of Colorado, without regard to conflict of laws rules.

18.2. Any dispute will be resolved in the state or federal courts located in Jefferson County, Colorado. You and CUP consent to those courts.

18.3. Before filing a claim, each side agrees to try in good faith to resolve the dispute informally for at least 30 days after written notice.

19. General

19.1. These terms, plus any order details shown at signup, are the whole agreement between you and CUP about your listing.

19.2. If any part of these terms is unenforceable, the rest stays in effect.

19.3. CUP’s failure to enforce a term is not a waiver.

19.4. You may not transfer these terms without CUP’s written consent. CUP may transfer them as part of a merger, sale or reorganization.

19.5. Notices to CUP must be sent to am@coloradounderpar.com or by mail to: Colorado Under Par, PO Box 151159, Lakewood, Colorado 80215.
