These terms apply when you create or use a free Colorado Under Par (CUP) account as a golfer, player or sponsor. They also cover the CUP Club rewards program. “CUP,” “we” and “us” mean Colorado Under Par. “You” means the account holder.
By creating or using an account, you agree to these terms and to our Privacy Policy. If you register for an event, buy a sponsorship or redeem a partner perk, other terms may also apply, as described below.
1.1. You must be at least 18 years old to create a CUP account.
1.2. Minors may take part in events only when a parent or legal guardian registers them. The parent or guardian is responsible for the minor’s registration, the event agreements, and any information provided about the minor.
1.3. You must give accurate information when you create your account and keep it up to date.
1.4. One person may have only one account. Business sponsors may use one account per contact person.
2.1. CUP does not use passwords. To sign in, you enter your email address and we send you a 6-digit code. The code works for a short time and only once.
2.2. Anyone who can read your email can sign in to your CUP account. You are responsible for keeping your email account secure. We recommend a strong password and two-factor sign-in on your email.
2.3. Do not share sign-in codes. CUP will never ask you for a code by phone, text or email.
2.4. Tell us right away at am@coloradounderpar.com if you think someone else has used your account.
2.5. You are responsible for activity in your account unless it happens after you tell us about unauthorized use.
3.1. With an account, you can:
3.2. CUP may add, change or remove account features over time.
4.1. Event organizers run their own events. When you register, you are buying from the organizer. The organizer’s terms and refund policy apply.
4.2. Event agreements such as liability waivers, codes of conduct and rules are between you and the organizer, and CUP is not a party to them. The one exception is photos and video: the CUP Media Release applies between you and CUP, and the event’s own photo release applies between you and the organizer. CUP may display or collect them on the organizer’s behalf.
4.3. When you register, the organizer receives the information you provide at registration. See the Privacy Policy for details.
4.4. CUP is not responsible for the event itself, including the venue, schedule, prizes, safety or the organizer’s performance.
4A.1. By creating an account or signing in, you agree to the CUP Media Release. It lets CUP use photos and video taken at events, which may include you, on the CUP website, social media, email newsletters and promotional materials, without payment. You can opt out at any time as described there.
4A.2. CUP sends emails about your account, your orders and teams, and anything you sign up for. CUP sends news, deals and updates only if you opt in, for example by ticking “Email me about events, perks and updates” when you sign up or in your account. Every marketing email has a one-click unsubscribe, and you can turn CUP emails off in your account at any time.
4A.3. The sign-in screen states: “By continuing you agree to the Terms of Use, Privacy Policy and Media Release. We email you about your account and anything you sign up for; news and deals only if you opt in.” CUP records the version and time of that agreement for each account.
5.1. When you follow an organizer or venue, or save an event, CUP may email you alerts about it. Examples include new events, date changes or reminders.
5.2. Every alert email includes a one-click unsubscribe link. You can also change alert settings in your account.
5.3. Unsubscribing from alerts does not stop transactional emails, such as sign-in codes, registration confirmations and important account notices.
5.4. Following an organizer or venue does not give them your email address or tell them who you are.
6.1. You can choose to show your friends which events you are attending. “Friends” means people connected to you on CUP, such as teammates on a registration or people who joined through your referral link.
6.2. This feature is off unless you turn it on.
6.3. When it is on, your friends may see your name and the events you are registered for or plan to attend. Your registration details, payment information and contact details are not shown.
6.4. You can turn this feature off at any time in your account. Turning it off hides your activity going forward.
6.5. Do not turn this feature on if you do not want others to know your event plans.
7.1. What it is. CUP Club is a free rewards program for account holders. You earn points through activities CUP chooses, such as registering for events and referring friends, and a birthday bonus if you add your birthday to your profile.
7.2. Levels and point values. The ways to earn points, the points for each, the CUP Club levels and what each level unlocks are shown on the CUP Club page and in your account. CUP may change them as described in section 7.9.
7.3. No cash value. Points have no cash value. They cannot be redeemed for cash, credit, refunds or payment toward registrations unless CUP says otherwise in writing. Points are not property and are not a gift card, stored value or bank account.
7.4. Not transferable. Points and levels cannot be sold, traded, transferred, combined between accounts or inherited.
7.5. Referral points. You may get a personal referral link. You earn referral points only when a new person uses your link and completes a real, paid event registration. Points are not earned for free sign-ups, for registrations that are refunded or cancelled, or for referring yourself.
7.6. No gaming the program. CUP may refuse, remove or reverse points that we believe were earned through fraud, duplicate or fake accounts, self-referrals, refunded registrations, spam or any abuse. CUP may also suspend your CUP Club membership or account for abuse.
7.7. How long points count. Points count toward your level for a limited time after they are earned, as shown on the CUP Club page. If CUP shortens that time, we will give at least 30 days’ notice by email or on the CUP Club page first.
7.8. Perks are from partners. CUP Club perks are discounts and offers provided by CUP partners, such as courses, venues and vendors. When you use a perk:
Perks may change or end when a partner changes or removes its offer. CUP will try to keep perk listings accurate but does not guarantee any specific perk will be available.
7.9. Changes to or end of the program. CUP may change CUP Club rules, point values, levels or perks, or end the program. We will give at least 30 days’ notice by email or on the CUP Club page before a change that reduces your points or level, or before the program ends. If the program ends, unused points end with it.
7.10. Closing your account. If your account is closed for any reason, your points and level end and cannot be restored.
7.11. Taxes. You are responsible for any taxes that may apply to perks you receive.
8.1. You agree not to:
8.2. CUP may remove content, limit features, or suspend or close accounts that break these rules.
9.1. You may close your account at any time from your account settings or by emailing am@coloradounderpar.com.
9.2. CUP may suspend or close your account if you break these terms, if we must for legal reasons, or if the account has been inactive for 24 months. For inactive accounts, we will email you first.
9.3. Closing your account does not cancel event registrations. Contact the organizer about those.
9.4. After closure, we handle your data as described in the Privacy Policy. Organizers keep the registration data you gave them.
10.1. The site and CUP Club are provided “as is” and “as available.” To the fullest extent the law allows, CUP disclaims all warranties, express or implied.
10.2. To the fullest extent the law allows, CUP is not liable for any indirect, incidental, special, consequential or punitive damages, or for the acts of organizers, partners, sponsors, venues or other users.
10.3. To the fullest extent the law allows, CUP’s total liability to you for all claims relating to your account or CUP Club is limited to the greater of (a) the platform fees CUP received from your transactions in the 12 months before the claim, or (b) $50.
10.4. Some laws do not allow these limits. In that case, they apply only as far as the law allows.
11.1. CUP may update these terms. We will post the new version with a new “Last updated” date.
11.2. For material changes, we will email you or show a notice when you sign in, at least 30 days before the change takes effect. If you keep using your account after that, you accept the change. If you do not agree, you may close your account.
12.1. These terms are governed by Colorado law. Disputes will be resolved in the state or federal courts located in Jefferson County, Colorado, unless a small claims court has jurisdiction.
